I have 3 liens: 1) $35K CC, 2) $45K CC and 3) $900 CC (all bloated from OCs). No. 2 lienholder, Nations Accounts Receivables Management seems to have gone out of business, I think or at least has changed names. I can't be sure. The had garnished $13K of my wages before I lost my job. I rent out my house because I could not afford to keep up payments. The tenants want to purchase. I have $225K in mortgage and equity loan, the house is tax appraised at $230K. The tenants will probably go for around $235K max which means I'll have about $7K up for grabs for the liens. I have no other money to bring to the table and am unemployed. I can't hold on to the house anymore and would like to sell to the tenants and begin to clean up the mess. I sent a debt settlement offer to No. 1 for $6K but no reply, (they had offered some time ago $11K.) My hope was to have No. 1 settle before I go to closing and work with the other two at closing. I am not sure how long I can go before default. Thanks for any help you can provide. |

What I am looking for is advice on dealing with CA and settling judgment liens so I can close on my house. Does anyone have experience selling their home with liens attached? I am not sure how to proceed. My thought was to try and settle prior to selling my home. I am not expecting any equity out of the house and I don't have money to bring to the table, I just want to resolve the liens, sell the house and begin the path of credit repair. Additional Questions: In one of the liens, the CC account number is misstated, would that be enough to dispute the judgment? Who do I try to contact for settlement, the lawfirm who filed the judgment or the CA? Should I have a contract for sale on the house first and hope the CA's will respond? The lawfirm of one of the CA is out of business, also that CA, Nations Account Receivables Management, appears to have changed names. I sent an offer letter CMRR but it was returned. The phone number called answers Foreclosure Management. Is this an opportunity to dispute? I am not looking for a dodge, I just want to move on. Thanks, in advance. |
