Default Open judgment on credit report

I recently had a credit decision turned down when they pulled my credit. The reason stated was "you have an open judgement for 14,000 to judgement creditor" on your report. I was stunned.

Upon a little research it was apparent what the issue was. I was in an accident and the "injured party" sued me for 14,000 after Allstate and him could not reach a settlement. It went to trial and I lost. The award was 14,000. The attorney from Allstate said he would consult with insurance company to see if they wished to appeal, which they did not. Payment in full was made on January 5th of 2010. The judgement creditor (injured party's attorney) had a judgment entered even though it was obvious I was insured and represented by an Allstate provided attorney. The judgement was satisfied within 30 days of the damages awarded. The check was cashed on January 7 after the December 16 trial date. Yet he filed a judgement that was recorded and until I called his office on 21 December had NEVER notified the court that that judgement was satisfied. And the attorney Allstate provided failed to contact the Plaintiff's attorney to verify that "Satisfaction of Judgement Notice " was filed with the court clerk (Virginia District Court).

I was able to get a Notice of Satisfaction after I called the judgment creator and told him of the issue with my credit report. But the cover letter asked the court clerk to mark the judgement as "satisfied". So this remains as a derogatory item even though the liability to pay was with my insurance company as their insured.

So my question is whether or not the judgement creditor is liable for negligence or I can seek any sort or relief to have this removed by the court since I was never served with any sort of notice?

Any ideas on how I should proceed, or should I just accept the fact that it is going to remain on my credit report for 7 years?

You're going to want to dispute it with the CRA(s) that are reporting it. Start here:
