I received a call this past Friday from a debt collector, called them back and left a message. On Saturday a lawyer called me back. He gave me the info., it was a bank loan from Oct. 2000 that I never even made 1 payment on and a collection agency wants the lawyer in GA to sue me. I moved from N.Y. to Georgia in early 2001, the collection agency is in NY, I still live in GA. I said this should be beyond the SOL, he said he will check to see when they reported it and something about my moving. I told him if I had the money to pay I would have done it years ago. He said the SOL in NY is 6 years, am I required to add more time on the SOL because I moved? Can they sue me, go after my bank account and all the other good stuff which the lawyer said they want to do? What are my options? Thanks for ANY help!!

No, they can't. It's way past the SOL. Tell them to stop contacting you immediately. Send them a cease and desist letter and tell them you are sorry about their luck. ![]() PS. Never talk to a collection agency on the phone. NOTHING good can ever come from it.

Thanks so much for the info., it was a lawyers office here in Ga that I spoke with. He said the collection agency in NY wants them to take me to court.

I believe them contacting you and threatening to take you to court is a violation of the FDCPA. Find out what the laws are in regards to recording the phone call and If I were you next time they called I would record the phone call.
