Default Public Record - Tax Lien Removal

I have had pretty good success removing negative items from my CR. The problem is this:

I had a Tax Lien posted in the Public Records section of my Credit Report. I disputed it for the time limit being expired for reporting.. It has been removed by all 3 of credit bureus (trans Union, Experian, Equifax / CSC) and I do not see it on my Credit Report. Now here is the problem....When my mortgage broker pulls my record when I applied for a home loan...the Tax Lien is still being reported. HELP! What is going on and what can I do??

Did you ask your mortgage broker where he gets his info? Which CRA is reporting it?
Have you pulled your reports yourself to see if you can see the tax lien?

Just wondering if it's been reinserted or your mortgage guy is getting it from another source.

This Public Record - Tax Lien is showing up on the "Mortgage Credit Report" and is only being reported by Equifax. It does not show on the Credit Reports that I receieve. Not sure how to demand a removal since I don't even see it on my personal CR's.

Interesting...
Well, I would call up equifax and ask them why it's showing up period. If they are reporting it to ANYONE, they should be able to see it. Then demand that it be deleted immediately.

By law, a TL cannot be reinserted without you being notified. If you had the tax lien deleted previously, then they have to remove it. If they say they can't see it or find it........ask if there is ANY chance you have a split file (this happens sometimes with EQ - I've had it happen to me).......if so, they need to remove it from that file too.

If there is no split file and they still can't find out why your mortgage consultant can see it, ask them to write a letter stating that this file is not being reported.......OR if they will speak to your mortgage guy (maybe on a conference call) and let him know that it should not be on there. Then at least he can make sure the underwriters know that it's a mistake and should not be taken into account.

Update:
I called Equifax and they assured me that I did not have a split file. They also woul not send out a letter stating that this tax lien was not on my CR, however the will resend the dispute letter indicating that the item was removed.

The real interesting thing here is that it is not the Credit Bureaus that are the problem. Mortgage Lenders utilize a Third Party Credit Collection Service. In this case it is Kroll Factual Data, which I believe is the largest 3rd party collector of data. They are reporting old information that is not reflected on my credit reports. The trouble is that they work for mortgage lenders and not the public. This means that since I am not technically a client of theirs, they have no obligation to respond to my requests. They update their records when they feel like doing so. My hope is that in June, Kroll Factual Data will update my credit file to be accurate with the Credit Bureaus.

People need to be aware that the 3 Credit Bureaus are not the only source of information utilized for loan decisions. But that there are Third Party Data Collectors that hold the power when it comes to maintaining accurate credit files.

Well I did know of a couple of other 3rd party furnishers but never heard of Kroll.
Have you tried contacting them? just in case they can correct the info for you if you provide proof that it's incorrect?

OR....

You may not be a client but your mortgage consultant would be.......right? Could you see if he could talk to them (if they won't deal with you)??

Hey, I just called Kroll and talked to a very nice CSR. She said you can most certainly dispute an item if they are reporting it incorrectly.
What they will do is dispute the item on your behalf with the CRAs (the regular big 3) and then if it's no longer being reported with them, it will be removed.



So give them a call!!

I have a MAJOR MAJOR problem on my hands.............

I applied for a mortgage and got pre approved with my fiance. Around this same time, I paid some back state taxes that I had owed for about a year or so........... After my pre-approval, I get a credit alert...guess what??? A paid tax lien shows up on my report.

I called the local courthouse and also the state DOR and they are mailing me a letter to send to CRA that says that my debts have been paid and that there are no liens on my record. The guy at the state said that it will be removed from all of my credit reports like it never existed once they get this paperwork.

I am getting ready to formally "apply" for my loan tomorrow and if they repull my credit, I won't qualify for the mortgage due to this terrrible lein being on there now. Does anybody have any advice they could give me for this crappy situation? Thanks in advance, I'm desperate!!!!

Oh no.
Talk to your mortgage consultant so that there are no surprises........see what he/she says. If you have proof that this lien is not on your CRs, they may be able to pull your CRs later for a rapid rescore. I don't know all of the details about that but there is a way for them to pull it later once the lien is removed. So talk to the mortgage company. I'm sure it's not the first time this has happened to someone. They should know what to do.
