...ex-wife and her children? THE JUDGE WANTS TO ADD TO MY HUSBANDS INCOME MY TAX RETURN WE RECEIVED WITH OUR NEW CHILDREN. aREN'T MY ASSETS PROTECTED? i SHOULD NOT BE RESPONSIBLE FOR HER CHILDREN. i HAVE MINE TO WORRY ABOUT AND ALSO, THE COURTS DO NOT EVEN CONSIDER THE SECOND CHILDREN IMPORTANT.

I dont know what attorney you have been talking to... No your assets are not protected... Everything is negotiable...Also, if your name is on it, then yes they are protected... If it is proven that there is collusion of assets, though, they will go after yours as well.... You need a good attorney to help you navigate thru this one...

FACTS because I know..his EX will get 1/2 of tax return if he is oweing back child support also IF you buy a house together if EVER you sale and he is behind she will get her due.. If you have children together his child support will be lowered that my friend is the FACTS

Maybe you filed a joint return; therefore, it is the entire amount that is available to him that is considered. You should separate that issue by filing a separate return from now on.

All you have to do is file as an injured spouse I think is what they call it. If your husband has outstanding bills like child support and such that they may take his return then you file separately and they can't touch yours at all. I don't think you exactly file separately, but your earnings don't get figured in on the amount that they count for him. I haven't had to do that in 7 years or so, not since I was married to my sons father and he owed a ton of money to his ex for support.

protection? i don't know of such a thing.first wife and their children come first, as far as whatever their divorce agreement they made states.then second wife and children. after all, he knew what he was getting into when he decided to have more children, no?sorry, but i believe if you are filing jointly and are contributing to the income of your family that it will be considered with his income.

You might try telling us where you live... it would help. that way, you won't keep getting all sorts of answers but rather answers as to the laws where you reside....

When you get married, your money is his and his money is yours. You both take on all debts and financial burdens from the other as well. First, find a good attorney to go through the details with you. If you own a house see about switching it from joint tenancy to "tenancy in the entirety". Tenancy in the entirety covers each spouse individually if there is ever a suit/claim against the other spouse - basically it keeps you from losing your house if one of you gets into trouble. It was designed for people who are self-employed, but may be helpful in this situation. You should also ask about your pension/401k. If that is protected from her, you may want to invest as much as you possibly can there. With some plans, if you need emergency money i.e. new car, down-payment for house, etc. you can take a loan out of the 401k and pay yourself minimal interest for the loan.

i'm appalled 2 think ur assets could be in danger! i wouldn't think so, but laws r crazy sometimes!
