Question Assistance needed pls! CRAs questions...

Hello!
I had bought all 3 reports and disputed 11 items (3 CAs) last month, I only got TU to delete 9 out the 11 items but not a word on the other two bureaus as of today, almost 50 days! I haven't pulled the scores to see if there was any changes either since I am planning to do that by end of next month.

My question is...what do i do? can they just ignore the disputes? should I resend them the same letters again?

I have other negative items that i was wanting to dispute on step 2. do I need to buy again the reports from them in order to get them to answer after 30 days or can i just use the ones that i already have?

And to finish, I have 2 charge offs, one was paid years ago, zero balance (Capital one CC) and the other has some 3K on it, both out of SOL. Can a dispute work? especially the Cap1 with zero balance already?

How did you buy the report? If you got it free the bureaus get 45 days to investigate after the dispute was received. If you actually paid for it directly from the big 3, they get 30 days.

When did they receive your dispute? You should have a record from USPS. Have they sent a letter stating acknowledgement of the dispute? Does the acknowledgement letter's dates correspond with the USPS record?

It seems like you have reason to request deletion of all items since they did not resolve the dispute process in time. However, without the questions I asked being answered, it might not be that way.

I bought the reports from My Fico website and the Experian one on their website. I sent the 3 dipute letters the same day, almost 2 months ago now. Only TU replied a bit after 40 days stating that they deleted 9 items. no words on the other 2 bureaus. So on Monday, I will be sending a follow up letter to both reminding them they haven't replied to my request, will include the copy of the letter and USP receipt and that they need to do so or delete the items? Well I'll start there, this time I'll do with signed receipt...Am I right? I can't get lazy/discouraged now

Eek, I really want to say yes the CB is past it's time but I can't get your hopes up. The problem is that I am not familiar with myfico and the reports it provides. There is weird complicated junk with the purchasing of the reports, some provide individual reports and trimerge reports and... who knows.

If the format of the report you purchase doesn't mesh properly with the Big 3's reports, the Big 3 may claim they deserve extra time to investigate. To be honest, I don't know if even this is accurate but I really don't want to get your hopes up until we get a for sure deal.
Here's what I suggest:

The senior members typically play on here on weekdays so I think waiting until Monday to make your battle plan would be smart. A senior member will review this thread and let you know if your dispute is past the time-frame. From there, you will know what to do on (hopefully) Tuesday.

Don't be discouraged though. We just need one more step and you could have won the Credit Bureau dispute lotto.

Thank you Yogurt for your inputs. The weird thing is that I purchased the TU and EQ at MyFico then I did EX on its own website since MyFico doesn't provide that then I sent all disputes the same day on Sep 09th then got ONLY the TU statement sometime around Oct 15th with the deletions, nothing about the others...At this time, even the 45 days time frame is past!

My plan was to go with the dispute number 2 of other series of collections (last 4) after I get their first replies so now I'm a bit stuck with timing. Not sure IF the 2 other bureaus ignore my letters or deleted the unverified items but didn't send me a notice? Do they do that as well? So my question is do I go ahead with my second plan or first follow up in writting with the silent 2 or buy the reports again to find out if all disputed items are still showing? I only have MyFico Watch monitoring and they only give me EQ score but not a recent report...maybe I just need to buy new reports and find out then go from there?

I would really appreciate some experienced directions if possible, I will hate to make mistakes or spend now when I could do it at a later time?

Assuming that the extension to 45 days authorized under FCRA 612(a)(3) does not apply, and since you did not request a free CR during the reinvestigation period, it would not, then the relevant statutory periods are as follows:

The CRA is required under FCRA 611(a)(1) to "record the current status of the disputed information, or delete the item from the file" as a conclusion of their reinvestigation within 30-days from the date of the dispute.

The CRA is then required under FCRA 611(a)(6)(A) to provide a written notice to the consumer of the results of their reinvestigation within 5 business days after completion of their reinvestigation. So, with the normal 30-day period for reinvestigation plus the 5-day period for sending notice to the consumer, a written notice of results is required by statute to be in the mail within 30 calendar days plus 5 business days from their date of receipt of the dispute. Tack on a reasonable mailing time, and you can begin to complain of non-compliance with the statute after approximately a month and a half after their receipt of your dispute.

If their investigation required any deletion or correction of information in your credit file, then FCRA 611(a)(6)(B)(ii) requires that, as part of their required notice of results of their reinvestigation (i.e., the notice they are requried to send within 5 business days of conclusion of their reinvestigtion), they are required to additionally send you a credit report that shows the revision of your file as a result of their reinvestigation. That is required if they have made any deletions. So if they did delete and did not provide you a credit report showing that those deletions had been made within 5 business days of their conclusion of their reinvestigation, they are in violation of FCRA 611(a)(6)(B)(ii).
