Suffering from a Tax Lien is on a distinguished road
Unhappy Incorrect data was verified in a dispute

I had a Federal tax lien. I got that lien withdrawn. Not just released, but also withdrawn, which means it should be deleted from my credit report. I disputed the lien with Equifax and said, "hey, this lien is withdrawn so please delete it."

It came back verified. I have certified documentation from the IRS, and can get it from the county recorder, that shows that it is withdrawn. This is a black-and-white factual issue, there is no question of opinion or interpretation.

What's my next step? Do I need to sue Equifax?

A problem with tax liens and other public records is that you quite often don't know who reported it. Private companies scan public records and dig up information that gets into your credit file.

My recommendation is to file a direct dispute with the furnisher of the information. There are two ways that come to mind to find out who they are.

First, under FCRA 609(a)(1), you can request their name and address from the CRA. Requests under FCRA 609(a)(1) cover any information in your credit file, but require payment of the current fee of $10.50.

Second, and the approach I recommend, is to file a request for the methods and procedures used by the CRA in investigating your prior dispute. See FCRA 611(a)(6)(B)(iii). This is generally referred to as a method of verification (MOV) request.

The CRA is the one party who must know who reported the tax lien to them. That party is the one they should have contacted during your dispute through them. Section 611(a)(6)(B)(iii) gives you the specific right to obtain their name, address, and if reasonably available, their telephone number. Section 611(a)(6)(B)(iii) does not require a fee for obtaining this information.

Once you have the name of the reporting party, simply file a direct dispute with them under FCRA 623(a)(8).
