Default Chase responded to 623 Letter - Is this valid?

So Chase responded to my 623 dispute letter with ONLY information regarding a payment made on the account. ONE payment. Nothing on the sheet they sent has any information about me. I'm disputing ownership of this acct. and they basically sent a letter and documentation stating "we processed a payment on this acct."

Yeah? So what...they don't include any information showing that the payment came from me. This can't be sufficient to prove the account belongs to me, can it?

What now?

following up. I just got off the phone with Chase Bank. The lady admitted they do NOT have a signed application on file for the account I am disputing. She says they just sent a second mailing of account statements. I asked her if those will prove the account is mine and she says maybe not.

She went on to say that I should allege fraud and then they will assign a team of fraud investigators to my "case" to investigate whether the account belongs to me or not. She said they will see if the payments were coming from my checking acct, yada yada yada.

I simply told her that I don't believe statements are going to verify the account is mine and if they do not have anything tangible that would prove the account is mine they should stop reporting it to the credit bureaus. She just kept asking me if I would like to start a fraud investigation. I don't! I just want them to either verify my ownership or delete the entry on my credit report! I'm afraid if I claim fraud I will have to provide a bunch of information that even I don't have. But isn't the burden of proof on Chase?

Any suggestions?

new update, I got a letter in the mail from Chase saying they do not have an application on file. Does this mean they will be deleting the account soon?

I would wait until after the next month CRA reporrting cycle for them, and see if they delete. If they dont, then send them a dispute under FCRA 623(a)(8) alleging the account is not yours.

Normally, to pursue an "account not yours" assertion, you would need some type of supporting documentation. The type of supporting documentation usually provided is an assertion that, if the account is not yours, someone must have used your identity to open it. Thus, an "identity theft (police)report" under FCRA 603(q) is your normal foot in the door as supporting documentation.

In your case, you might not have to go that far. Supporting documentation for your assertion has already come from the horse's mouth. They tentatively "confirmed" your assertion by an admission of the lack of relevant account records. You could use that admission as the supporting documentation for a direct dispute under FCRA 623(a)(8).

Thanks Lian. That's what I'm hoping for that they just delete it. The lady on the phone said they mailed out statements on the account as far back as they had. That was over a week ago and I haven't received them yet.

When I talked to her she REALLY pressed me to allege fraud. She said then their investigators can "DIG" into my checking account and they can see if any payments were made from it! I'm sorry, the only investigators I would be okay with digging in my bank account would be those from MY BANK, not a credit card company...is that unreasonable? This is why I don't really want to claim "fraud."

By the way, all of this was started by a 623 Dispute directly to Chase. It seems to me at this point they should be doing the most thorough investigation they can. I shouldn't need to raise a fraud flag with them to get a more thorough investigation.

I did send a new dispute to the CRA letting them know that the creditor has been unable to provide sufficient documentation that the account is mine. So hopefully that helps as well, although I know it may not do anything.
