I have an old Capital One account from 2004 that was apprantly purchased by NCO financial. They reposted the debt as theirs in April 2008. Are they allowed to post this debt as new? PS been lurking here awhile and you guys have been a big help. |

A judgement has also been made against this account if I pay it will the judgment be remove or just marked as paid? Is there a way to get a Judgement removed?

Debt itself is debt. What is old or new is the date of each delinquency in payment along the path to satisfying the debt. When the debt collector purshased the debt, what they posted was their initiation of collection activities to secure its payment. That is totally legitimate. The date they reported does not control how long the collection can remain in your CR. Reporting by a debt collector, regardless of when it is reported to the CRA, must cease inclusion in your CR after 7 years plus sis months from the date of your first default with the OC in the most recent chain of delinquencies that preceded the collection. That date is caste in stone. |
