Default Just want to do a pay for delete

Why would you need to send a Debt Validation Letter if you just want to pay to delete? Can someone explain why? I assume a debt validation letter is so you can get the collection agency to admit that they do not own the debt and not bother you. Can you use this method to get it off your report? Wouldn't the original credit just go back and assign it to a collection agency again?

Debt validation letters relate to debt collection practices under the FDCPA, and are usually sent for two reasons. First, to request that the debt collector verify the amount of the debt, and second to invoke your right to require the debt collector to cease further collection activities until such time as they provide validation. If neither of those reasons apply to you, then you don't need to DV them.

DV letters are not for the purpose of determining ownership of the debt. A debt collector can be acting as a collection agent for the original creditor without being an owner of the debt.

DVs are essentially unrelated to credit reporting. Sending a DV letter, or lack of a response by the debt collector, is not grounds for removal of their reporting to the CRA. CRAs are not a party to the DV process.

Hmm then what would be the purpose of sending on out. All you get is the interim time period? What kind of letter can you send to deal with just the original creditor and not the collection agency.

Depends on the kind of debt but a 623 letter is usually preferable.

IF you want a pay for delete.. just send them a pay for delete. Agree to pay the amount in full in exchange for considering the debt paid in full and removal from your reports.

A DV letter helps determine who legally has the right to collect the debt. If a person knocked on your door and when you answered told you to pay him $25 because you borrowed $20 from his friend 5 years ago; would you pay him? What if he said you had to pay him because he bought this debt from his friend? What if he went around telling all of your neighbors to not loan you anything because you don't pay your debts? What if he had you mistaken with someone else?

Do you automaticly assume just because someone says pay them you owe them? If that's the case you owe me $1000. Now pay me because I said you owe it!!!!!! lol, I'll even write you a letter saying you owe me and mail it to you if you want.

Honestly, I think the better question is why wouldn't you do a debt validation?

If you want to pay for delete and don't want to give the scum sucking bottom feeding Collection agencies any money go straight to the OC and offer them a PFD for recalling the debt from the Collection agency and having them remove the negative tradelines they posted and consider the debt paid in full. I've had success twice with this method.

DV letters aren't just for hoping a CA can't prove it and delete it. They serve many purposes. You are operating under the assumption that everyone who has been referred to a collection agency owes a debt and that simply isn't the case. DV letters establish where the debt came from, ownership of the debt, amount of the debt, how that amount was arrived at, who to pay in order to legally resolve the debt and they can help initiate the process of filing suit to remove something erroneous from your records if it has to go that far.

Debt validation isn't just some "trick" to get you out of a debt. It is much, much more.
