Here is what is I received from a bank I 623 disputed with the OC. This account has a zero balance and was settled. How to proceed? Send another 623 asking for actual proof? Is that an option? RE: Visa account ending in XXXX Dear Cardholder: Thank you for you recent inquiry regarding the account listed in your credit report. As a result of our investigation we have determined that the information is reporting correctly, therefore no changes will be made to your credit report regarding this issue. The account information that was disputed is listed below: *Verify all account information reported If you have any questions, or if we may be of further assistance, please contact our customer care department directly at 1800XXXXXXXX. Sincerely, X bank |

Unfortunately, the credtor is only required to conduct an investigation and report the results back to you. The dispute process does not require that the results of an investifation must include legal proofs in support of their conclusion. Some discussion of their rationale would be appropriate, but is not a legal requriement. To get legal proofs, you would have to resort to civil action, thus availing yourself of the legal discovery process. Once an investigation of a dispute has been concluded and the results reported back to you, the creditor can dismiss a second dispute on the same issue as being "frivolous or irrelevant" unless it includes new information not previoulsy submitted. Do you have new information that would be sufficient to support a new dispute? |

what else could I dispute?....I settled the account...I wish I would have known what I know now when I settled. I can't even PFD since it has a $0 balance.

The other OC that I sent a 623 posted additional negative information in the comments. I assume I'll be getting a letter from them saying the same. If I file suit would it even be worth it for the OC to fight it? Both accounts are out of SOL. |

If you file suit, then SOL is immaterial. You dont assert an affirmative defense as the plaintiff. If you file suit then you can compel legal discovery of information. It depends on how good your case is. |
