Default Need some advice about ID Theft and CA's..

I am trying to clean up my credit report by getting rid of some collections that are on there. I have some stuff I’m working on in another thread but that’s separate from this issue.

My issue. I was going over my credit report and saw a collection from Midland Professionals on there that was listed as paid in full. The original creditor was Cox Cable.

Several years ago my father had opened up some utilities in my name without my knowledge, one of these was with Cox cable. He and I literally have the exact same full name.. first, middle and last. The only difference is there is a “JR” associated with mine. Well, My father and I hadn’t spoken in close to ten years because of his drug and alcohol issues and he ended up dying from those issues in July of 2009.

About a year ago I moved to a nearby town where Cox cable provides service and I tried to open an account. They told me I had an old outstanding balance of $180 from 2004. I knew immediately that it was my father who opened this account and left it unpaid because of the name and because of the dates of service.

I just went ahead and sucked it up and paid the amount due on the old account and started my service.

Well, recently I decided to clean up some of my own credit stuff and I saw Midland was listed as a collection agency on my reports. They have the account listed as paid in full and the show the original creditor as Cox Cable. I immediately disputed this debt online with the reporting CRA as not being mine and belonging to someone with the same name but it came back as verified by Midland (which suprised me they verified it because it’s already been paid in full).

When I paid this, I had no idea that it was in collections when I did because I paid the original creditor. Which brings me to my question.. Can Midland still report this on my CR even though I never dealt with them and paid the OC directly? and my second question which is also one that I am having a bit of a moral issue with, should I consider filing a police report against my deceased father for identity theft? Is it even possible given that it was almost 7 years ago that it happened?

When he died and I went through his things I found a photo copy of my social security card and there was also some documents from my insurance company denying payment because his DOB did not match mine. It appears as though he went for med service and they just saw the name and asked if his insurance was the same and he said yes, even though he did not have any, the hospital must have then sent my insurance the bill and they (the insurance company) denied it because of a dob discrepancy.

I guess the bottom line is I want this off of my credit report. How should I go about it? Can I legally file an ID theft police report given that it happened over 6 years ago?
