Default Some Help... Complex Situation

I was the victim of identity theft/fraud. My brother used my personal information to open a credit card up. I had no idea he had done this until i received a letter from a debt collection company. I was like what in the world is this. I tried to contact the original creditor and explain to them what happened and they told me to call the collection company and that they could do nothing for me. I told the collection company what happened and they investigated my claim and found me to be the person NOT responsible for the accounts. They had my dirtball brother fill out a responsible party affidavit which states he is the person responsible for the accounts.

The account was turned over to him for repayment. However i tried to dispute this with the original creditor again and there weren't having any of it. I successfully disputed this with Experian, but Transunion and Equifax continue to confirm this account belongs to me. Anyone have any input on this that can be helpful for me? I did file a police report and such when this first happened.

Experian is usually the hardest to deal with. The others should be easier. Try disputing them in another way. Don't give a reason or give a different reason.

Stay persistent. Dispute it until they delete it.

Have you written dispute letters with an attached police report and the affidavit that your brother signed stating that he was responsible for debt to all 3 bureaus or the 2 still showing it as a valid debt?

As of this morning I am down to just Equifax. Yes i have sent in dispute letters along with paperwork showing that i am not responsible for the account. Equifax is ignoring the letters and contacting the OC directly and confirming the valid account.

Look on the Equifax credit report and get the record or file number listed at the top. There should also be a phone # that you can Monday through Friday until a certain time of the day and actually speak to a rep. about why they are validating something that is actually fraud. When you speak to them, they usually will re-investigate and probably ask you to send the information again, but to a specific rep. It will get resolved. Just be a little more patient. Let us know what happens.
