Default Cell Phone Collection Please help

Hello Everyone,

there is a tmobile acct for a cellular phone that is on my credit report that has been sent to the law offices Mitchell Kay for collections. I sent them a DV letter and I received a letter from William W. Siegel stating that they are going to obtain the required information. The second letter in which i received today was a last phone statement in which the acct became delinquent in 12/03/2007.

Is this past the SOL in CA and if so does it mean that i can report that to the CRA's from them to removal? From my understanding from reading on here is that if it is past the SOL it just implies that they are no longer able to collect on the debt. Just need some clarification.

Also if it still remains in the SOL what would be my next step for removal? Is a copy of the last statement good enough for a debt vaildation?
Should I do PFD?

Any suggestions Please help.

SOL has nothing to do with what is reported on your credit report. If the SOL is 3 years, then they can't collect on it after that time, but the CRAs can still legally report it for up to 7 years.

There are a few things you can do. You can pay it and then dispute it. You can try to negotiate a PDF. You can try the 1-2 punch. You can try debt validation...you have many options, it's up to you.

Thanks for your response chane.
I actually read a Lot of your threads and took your advice of the 1-2 punch. I have heard back from the CA as I previously mentioned but did not hear anything from the CRA's. I sent out verifications to the CRA on June 11, 2010. Should I wait for the response from the CRA's before proceeding with any action to the CA?

You should have received something from at least one of the CRAs by now, it seems. But, yes, you should wait until you receive a response from them.

Thanks for your help. I'll wait for the CRA's to respond and hopefully I'll see a delete when they respond! I'll keep ny fingers crossed!
