Ok lets start with what happened first! So you know what is going on. When I got out of the service and moved back to Nevada, my were separated at the time and she stayed in Washington, got a lawyer and filed for divorce, She put on the divorce papers $525 TOTAL child support per month, The judge signed the papers and it got recorded somehow as $525 per Child per Month ($1575 per month) well I did try to talk some sense into Support enforcement but that did not work and I never got a lawyer to take care of it (I know, call me stupid but yes I was young and dumb and didn't know any better) know I have this to contend with: STATE OF CONFUSION SUPPOR N/A 07/1987 $xxxxxx 04/2010 PAYS AS AGREED - Account Number: XXXX Current Status: PAYS AS AGREED Account Owner: Individual Account. High Credit: Type of Account : Open Credit Limit: Term Duration: Terms Frequency: Date Opened: 07/1987 Balance: $xxxxxx Date Reported: 04/2010 Amount Past Due: Date of Last Payment: 04/2010 Actual Payment Amount: Scheduled Payment Amount: $xxxxxx Date of Last Activity: 06/2006 Date Major Delinquency First Reported: Months Reviewed: 45 Creditor Classification: Activity Description: N/A Charge Off Amount: Deferred Payment Start Date: Balloon Payment Amount: Balloon Payment Date: Date Closed: Type of Loan: Family Support Date of First Delinquency: N/A Comments: What can I do or am I stuck with this on my report well . . . Forever considering the amount it is. :eek: And yes I am still paying on it but i cant get any credit to help me with other things in life like buy a car or a house |

I was reading in the FCRA that § 622. Information on overdue child support obligations [15 U.S.C. § 1681s-1] July 30, 2004 68 Notwithstanding any other provision of this title, a consumer reporting agency shall include in any consumer report furnished by the agency in accordance with section 604 [§ 1681b] of this title, any information on the failure of the consumer to pay overdue support which (1) is provided (A) to the consumer reporting agency by a State or local child support enforcement agency; or (B) to the consumer reporting agency and verified by any local, State, or Federal government agency; and (2) antedates the report by 7 years or less. Well I'm not overdue and this is 23 years old so I really don't get how it is still on the report, unless the loophole they are using is that it is a current and up to date positive account which can stay on the account indefinitely? I need help from the experts here as i am a noob at this and just started to take a stand on getting my and my wife's credit straightened out |

It's wise of you to go through the FCRA, I like to see that. Most people don't take the time to do that. Knowledge is power - you are on the right track. Anything on your credit report can be disputed. You do not have to give a reason for disputing. The burden of proof is on the CRAs. Once you dispute an account, the CRAs are the defendant and you are the plaintiff, not the other way around. Does that make sense? A lot of people don't quite get that. It's very important to be of the right mindset when dealing with these people. You can also dispute it as many times and in as many different ways as you want. You just have to wait 30 days between disputes.

We disputed with Equifax, which was reporting my husband's child support as a "collection account". We disputed it on the basis that it wasn't a collection account, and it was removed. Perhaps since they are reporting it as a loan/credit account, you can dispute it this way as well?

Great News then, I thought I was stuck forever, I will try a few things and let you know how it goes, Thanks for the the help!:D Jenni would you have a copy of the letter that you sent them so I can use it as a template and modify it for my case, if not that's ok. |

It was actually surprisingly easy for us. We disputed it online instead of by letter, and just wrote "This is not a collection account. This is a child support obligation and never reported as collections. Never past due." It was the easiest to remove! Good luck! I would write something to the effect that "this is not a loan/credit account as being reported". |

They are child support obligations and never reported as collections. And never past due. The following information therefore needs to be deleted from the report as soon as possible: STATE OF CONFUSION, acct. 123XXX STATE OF CONFUSION, acct. 45XXXX Please delete the above information as quickly as possible. Sincerely, [Zenman] if it looks good I will send it off as soon as I can, or should I put something about FCRA §622 in the text |

I wouldn't give a reason. I think it's unnecessary and usually does more damage than it does good, but it's totally up to you. I would also never dispute online.

OK, Thanks for the advice, also I would never dispute online, Except when I started I did dispute the names and addresses on equifax and it worked good for the most part, Just have one address left to get rid of but I don't think they will remove it due to the fact that it is attached to one of the collection, But that is another story! LOL
