CA just called me even though I stated in my DV letter for them not to. The info they sent back after DV letter was a computer printout of medical stuff they typed themselves. I already disputed this through EX and EQ and they didn't delete. How can this be proof of the original debt. The lady from the CA told me I needed to pay it and I told her I requested the original documents. She told me she didn't have them because it was so old (6/06/07 and 7/04/07)and that I would have to get them from the doctors office and they probably don't have them either. Should I file an FTC complaint for not properly investigating and send the computer printouts to EX and EQ and demand deletion along with the FTC complaint? I just don't see how they could legally collect without the original bill. I need some help please.

How does this sound as a reply to the CA? In regards to your itemized statement sent 12/18/09: This is NOT the information I requested. I refuse to acknowledge this account or debt. You have not provided proof that you have the right to collect on the alleged debt or even an original bill for the alleged debt. The only thing you have provided is a computer printout that was typed on your own system. You have not provided any proof that the debt is mine or that you are legally allowed to collect on it. You have violated the FDCPA and must stop all collection attempts. If you do not remove all entries from my credit reports you will be in violation of the FCRA. You must remove ALL entries from ALL credit reporting agencies immediately. You have also contacted me by phone on 1/22/10 which I previously stated you are not to contact me by phone at any time. All communication will be done in writing. I repeat, you must stop all collection attempts and remove the negative entries from all credit reporting agencies. If you fail to do so I will send a complaint to the federal trade commission and the (state) Attorney Generals office. If you continue to violate my rights I may be forced to take legal action. How does this sound? Is there anything I should add? |

If this is a medical debt, depending on the specifics, u may want to look into the HIPAA process. You have not really provided enough info here to assess whether this would be an option, but you should at least look into it.
