Default can ,oc and ca come after you

:eek:Hello to everyone again ,hope everyone is having a good holiday season. Ok I have been dealing with a ca and paying on judgements "2" the original debt is from our local hospital. Several little ones that the insurance hasn`t covered or there is a remainder left over after the ins has paid. The funny thing to me is the collections are from the ca,and when we went to court for the judgement`s we face the ca`s lawyer. So when i pull my cr it says the jm is for the oc {local hospital} so I call the oc and ask if i can pay them. Nope is the answer ,they cant do that it is in the ca`s hands already. So how can the ca collect and the oc sue me to at the same time. Maybe i`m missing something? SO is this legal?

It sounds to me like the OC handed over the debt to a collection atty which turned around and sued you and got a judgment(s) on you. Since the atty was representing them.....they were awarded the judgment.

Once you have a judgment against you, you can only deal with the atty that represented them.. as far as making payments.

I'm a little confused as to how it's reporting..
Would you mind posting how it appears on your CR? Then I can possibly tell you if it's being reported correctly.

ETA: Also (because of the title of your thread) what do you mean by come after you? If they have a judgment against you they can most definitely freeze your bank accts and/or garnish wages if that is allowed in your state.

Ah... yes, it looks like the hospital hired a CA to sue you....but they (the OHP) is the one that has the judgment against you.

You would still have to deal with the CA atty regarding payments.

Have you read this thread? You may want to try it.

Yes, as Trish commented. When a debt gets handed off to an attorney, he is collecting the debt on the hospitals behalf. He gets a cut of what he collects, hence why any payments need to go through the attorney.

As far as how it appears ok your credit report, it lines up with what you've represented here. However, to be certain, simply look at your court paperwor ( is summons and complaint or even the actual judgment) and see whom the plaintiff is. The name of the plaintiff and the name on your credit report should match.

Hey guys and gal.Thanks very much,Ill look at all the paperwork and check to see if it matches ,sure am glad I found this site ,already been helped alot,But you people are right all us newbies need to read read read and read some more,lol.....

Ok lets see if i can catch them in anything unlawful,,If the hospital got judgement and that`s waht the paperwork says ,but it also says that it wa file by the ca`s attorney,I did a little a sneaking around through a family member and found out that the hos,doesn`t hire the attorney but the ca files all the paperwork for the hos ,,,now is that legal??? and also since they got judgement can the ,ca, report that i still owe the original bills to them ,or how should that be listed since the hos has the judgement ? seems to me like they are playing toss the ball ,,,,,and again thanks

I really don't see anything out of the ordinary here....

I was sued in the past..... The OC sold the debt to a CA (Midland funding)....the CA then turned around and hired a lawfirm (Suttell and Assoc) who got a judgment against me.

The lawyers names are all over my court papers but the CA is the plaintiff.
The OC is on my reports for the CO. The CA also popped up on my CRs as a collection acct. THEN I also had a judgment in the public records section reported by the courts with Midland's name on it.

It can be reported twice, even three times....... but between the OC and the CA, only one can report a balance.

It depends on whether the hospital sold the debt to the CA or whether they are just collecting on behalf of the hospital. If the hospital is the plaintiff then it's correct for the judgment to appear in the hospitals name. CA often hire attorneys to collect the debt so nothing u have said seems shady.
