Default paid collections question

So I paid a collection in feb before I foun this site and ill called them up to see if they would remove it and they said no. Now they have terms on the TL which from what I understand are a violation? So what is my next move to get this removed?

Send them a letter informing them that they are not reporting the TL accurately and if they do not delete it immediately that you will either seeking legal counsel or filing a lawsuit (which ever you feel more comfortable saying).

I wouldn't even specify just yet how they are violating.......let them figure it out.

There really no sample letter for this.......so if you want to post your letter and let us critique it, you can.

And that is a violation of the FCRA correct? And if you want to complain you complain to the FTC?

Actually it violates both the FCRA (sect. 623) AND the FDCPA under False or misleading representations [15 USC 1692e].

Also in your letter you should mention you will be filing complaints with the proper authorities (FTC, BBB and AG).

To whom it may concern,

Your company is reporting the above referenced account on my credit reports inaccurately. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid.

In a good faith effort to resolve the matter amicably, I must demand that you immediately removed this account from my credit report as you are in violation of both the FCRA (sect. 623) AND the FDCPA under False or misleading representations [15 USC 1692e].

If no such deletion is completed within 10 days from receipt of this notice I will seek legal counsel and file complaints with the FTC, BBB and AG Office. If you singularly or severally fail to comply with the above requests, I reserve the right to seek damages against all parties, under all available State and Federal statutes.

Not bad...

The only thing I suggest is spelling out FTC, BBB and AG instead of using acronyms........but otherwise I think it looks good.
