I'm having an issue with a CA (New Century) who is collecting a debt for a charged off Household Mastercard account. They have issued a court judgement; they have a listing under collections, and are listed in the credit card section of my credit report. Is this legal?

What is being reported to the CRA are separate items of information related to continued delinquency on the debt, and not the debt itself. An OC can report monthly delinquencies on the account/debt, then a charge-off. A debt collector can then report their collection of the debt, either as an assigned collection agent of the creditor, or as the owner of the debt. Each is a separate item related to the history of the debt/account, and can be separately reported. Their effect on FICO scoring is similarly cumulative. New reportings don't erase the accuracy of prior reportings. |
