there's a collection listing on my report from "Natl Recover" for $68, so I was trying to figure out what it was from to see if I actually owe this debt. It lists the original creditor as "Capital Management Ventures" which I have never heard of so I looked it up to see what it was and it is a collection angency!!!! How am I supposed to figure out what this debt is and if I actually owe it!?!? I am so frustrated I feel like this is a never ending battle. I know I have made some mistakes with my credit in the past but this is ridiculous, how can I fix them if I don't even know what they are for!!! Can anybody give me any advice on how to figure out what this debt is and what steps to take? Feeling so stressed right now. |

First of all it is a low dollar amount. This is good news for you because once you are armed with the tools to fight back, they aren't going to want to deal with the pain of complying with the law vis a vis your consumer rights. I would do two things: first send a debt validation letter to the collection agency. Here is a link to learn more about that - Debt Validation - Your Rights Under the FDCPA. It is a pain because they are a complete joke. The burden of proof is on them to show that you owe the debt. Meanwhile I would send a dispute letter to the credit bureaus to dispute that it is yours. Send the Debt validation letter to your collection agencies first. Then Send your Dispute letters. This is called the 1-2 punch (there is a thread stickied in the beginner's section regarding this method and why and how it's used). Regardless of what some people tell you, you can dispute online. I've had extremely good success doing this and you also get immediate verification they received your dispute via an email they send you. If you do the 1-2 punch and send a Validation request to the CA and they verifiy the debt with the CRA before it's been verified with you there is an FDCP violation and you then have grounds to sue them for $1000. If this happens there is absolutely no reason to fight you on that $38. $38 dollar profit to have a $1000 loss? Makes no sense and you should be able to get it removed. anyway, first step is DV and then dispute it. Good luck |
