I lost a home in foreclosure that had a 1st and 2nd. Even before the foreclosure (while trying to short sell) the 2nd mortgage holder charged off the debt. They tried to settle (outside of the short sale), but I just didn't have the cash My credit shows a CO (charge off) and zero balance. However, I was contacted by an agency that bought the bad debt. They send statements, but that's about it. They don't really call or anything. I got wise and pulled my credit report and they don't even report themselves on my credit as an installment loan, revolving loan, or collection. Should I ignore them until they try to sue? There's no way I can pay them either. I talked to them and they said they would settle for $5000, but I don't have $5000 to give. I was going to make payments until I noticed they aren't on my credit report. I figure if they sue, I can defend my position at that time (I may just ask them to produce the original document that shows that I owe them anything). Advice? Input? |

I personally would leave it alone until they show up on your credit report. If they aren't already, they probably won't, but who knows? If they don't show up on your credit report and they haven't sued you, try to wait it out... Statute of Limitations
