Question old collection account questions

Ok so I'm doing the 1 2 punch. On one of my collection accounts from afni says last activity 7/09. The collection agency sent me verification of the debt and it shows that the actual last activity was 5/05. I have not been in contact with anyone about this account since 2005 on purpose due to disputes. Why or how can the collection agency say the last activity is 7/09? What would be considered as last activity on a collection account?

Date of Last Activity (DOLA) is the last day that you made a payment to them. So, if they are reporting otherwise they are simply violating your civil rights. It's illegal as hell.

If they don't remove it immediately, you have the option to sue them.

That is what I’d call re-aging a debt. Start to keep really good logs because if you are ever sued, you can use that as a countersuit. This is a collection agency thinking they are above the law. Don’t throw away any statements or documents you may have about your account. Some day it might come down to you just showing your documents versus none of their documents -- calling their bluff. But always challenge them without admitting anything, i.e. I need proof of this debt because your records of what I owe does not match my last statement of what I really owe, so you see this is why I need validation ….

I am not saying to ever show a debt collector your actual statements, but use any inaccuracy to challenge them and make them prove everything. In other words, use the law to your own advantage. If it ever comes down to it, make sure you countersue on the basis that this agency violated the law by re-aging your debt … say something like, which is why I never dealt with actually paid them ….

Can you tell what activity occured on that date?
Usually, illegal re-aging refers to a reset of your DOFD. No DOLA resets the DOFD or extends the period that the collection remains in your CR.
I would suspect that the last activity being referred to was probably some action or reporting taken by them. I would be hesitant to assert illegal activity on their part until I knew what activity was associated with this reported DOLA. It could be innocuous.
