Default Question about Cease & Desist Letter

Is there a time limit on when to send a cease & desist letter to a CA? In your sample letter you state to "send out the letter in 30 days of first contact." They sent the first notification July 23, about 3 1/2 months ago. They only sent 2 notices but are now calling me 5-6 times in a row every single day!! I have not spoken with them but did speak with the CA who had this debt before them. I definitely want to try a pay to delete with the OC so can I still send cease & desist?

You can send a C&D at anytime asking anyone to C&D. If they don't C&D you can sue them.

You may not want to send a cease and desist letter if you're trying to negotiate a pay for delete.

That's like saying "Don't ever contact me again! Oh, by the way, will you agree to delete this item if I pay it off?"

They won't agree to shit if you ask them not to contact you. lol

But can I send the collection agency a c&d then send the original creditor a pay to delete?? They are not one in the same. I read somewhere that it is easier to get the original creditor to delete an item than the collection agency???

I would make sure the OC agrees to the pay for delete before you snub the CA because sometimes the OC won't deal with the account once it's been sent to CA. That's why they hire CAs.
