Default DV ...claim against surety bond??

I requested validation from a CA and they sent me a computer printout of one page from 3 different billing dates. Below is my response to them....but my question is this....if they do not properly validate the debt with me....how do I file a claim against their surety bond and file suit on them?

To Whom It May Concern:

I am sending this letter certified mail # 7009 3410 0001 xxxx xxxx to ensure that you receive it.

I have received a letter from you dated 10/28/2010 yet your offices have failed to provide me with proper validation. I sent you a letter on 10/22/2010, certified mail # 7009 0960 0001 xxxx xxxx, which you signed for on 10/25/2010. You have not supplied sufficient evidence that the alleged debt is mine.


In a good faith effort to resolve this matter amicably, I restate my demand for proof of the debt:

• Provide me with copies of any papers that show I agreed to pay what you say I owe;
• The original date of default or non-payment of the debt;
• The date the original debt was transferred from the original creditor to the third party debt collector;
• Prove the Statute of Limitations has not expired on this account
• Proof of your surety bond;
• Provide me with your license numbers and Registered Agent

Absent such proof, you must terminate this collection action and correct any erroneous reports of this debt as mine.


You have fifteen (15) days from receipt of this notice to respond. Your failure to respond, on point, in writing, hand signed, and in a timely manner, will work as a waiver to any and all of your claims in this matter, and will entitle me to presume that you sent your letter in error, and that this matter is permanently closed.


Either provide the proof or correct the record to remove the invalid debt from my credit files with the three primary credit-reporting agencies. You are currently in violation of the Fair Credit Reporting Act and the Fair Debt Collection Act.

All future communications with me MUST be done in writing and sent to the address noted in this letter by USPS.

This is an attempt to correct your records, any information obtained shall be used for that purpose.
