There is a JDB attorney that has been to court 4 times in the last 18 months trying to convince a judge to allow him to "serve" us via alternative methods (post in the news paper etc). The judge has slapped him down every time.... Whew... ![]() The SOL is almost up. The Question: Can he "legally" still get a judgement after the SOL is up because he "attempted" to serve us prior to the SOL expiration? I know he can still TRY to sue us and can plead his case to the judge, but if he is "unable" to serve us prior to the SOL, one would think he is out of luck. For the record... I am going to attempt to settle the debt with the OC after the SOL is up and get a PFD. There were fraudulant charges on the account that the OC failed to investigate. That is how we ended up here. Man, this place has gotten quiet. I am surprised with 1/3rd of America in foreclosure. I send alot of people to this site. Fly |

I don't think they can under any circumstances, once SOL is up.

Thanks Chane... yeah, a couple of months to go... I am sure he is aware of the SOL if he a a "saavy" JDB. If there is such a thing. Even if he was able to get a judge to go along with him, which is doubtful after 4 previous attempts, I would appeal it with the fraud info and tell the judge it is up to the OC to correct the account.
