Default 1 more:crazy CA!!

I am dealing with a CA and have some questions. I have finally decided to pay this bill wen it went to collections. They sent me a seettlement offer and paid in full, but 16 days instead of the 14 they dated on teh letter, it took a couple to get there. I then called and said the payment would be there that day, the guy told me that know i need to pay the entire bill, another $600. I asked him to talk to a supervisor, he cam eback and said they would settle for 200 more. Then I told him no and asked if he would send me that in a bill, he became very rude so i said i would think about it and call back. Later that day I called back, asked to speak to someone else and they hung up on me. I called back again asking to speak to someone else, a supervisor or another agent, they told me no supervisor was present and i needed to deal with this one guy. I did say I didnt want to work with him on this because he was very rude and I am trying to pay this and cooperate with them. This was all yesterday and I decided to try to get help before calling again.

Anyone had anything like this happen or have any idea what I could/should do.

By any chance did you pay by check? If so, I would put a stop payment on it NOW. Then send them a DV letter.

And yes, I have had to deal with A-hole CAs too. They are scum.....and you should never have to put up with crap like that.
Let me know if you can get your money back.....depending on that will make a difference on what you can do and how much leverage you have.

I did pay by check, but it wasnot my account, it was the girlfriends. I dont think I would be abel to stop payment because it should be at the bank today.

I was thinking about sending them a PFD now if they wont settle for what i have already paid. Since it is under 500, possibly only 200 more would this be a good idea? I am guessing it is to late to send a DV letter for the remander of the balance since i have already paid most of it or can I dispute the total balance they say I owe?

These forums have already helped me a lot.

Even if the check were to hit the bank today, your gf could call the bank and tell them not to pay it. It never hurts to try. I wouldn't pay them a penny if they treated me like that..........until they can provide some proof that it's yours and they have the legal right to collect on it.

Yes, you can do that. Send them a DV letter........you would have to modify it a bit (if you use one of the form letters). You would need to state something saying........I have already , in good faith, paid you $xx.xx amount per our agreement that you would consider the account settled and paid in full (btw, that's BS that they back out of a deal because it was 1 or 2 days late) and now you are requesting more........I hesitate to send you anything more until you provide proof that this alleged debt is mine.

Something along those lines.

I really hope you could just put a stop on the check because then the ball would be in your court. You can put more demands on them before you give them any money.

thanks for the help on this one.

I called back today and they said I have no remaining balance(which isnt really what i wanted to hear, now i cant PFD), but either way I guess its paid and they are sending a reciept and hopefully its over.

Do you think I should try to get them to delete or is that a waste of my time?

Obvouisly I would love to get this of my report.

Definitely try and get them to delete it. From the sounds of it, they may not be too accommodating........but you should ask.

Definitely dispute it with the CRAs and hopefully they will just remove it. If they are a pain........be persistent. At this point you have nothing to lose right? So keep calling them. Tell them that was what you thought the arrangement was upon payment. Hopefully they will just want to be rid of you and will either delete it or NOT verify it when you dispute.

Default need help again!

So after all this I just recieved my dispute backfrom TU. It is now showing that the OC from this account is claiming that I owe the remaining balance. I paid the settlement amount with the CA, they told me that it was satisfied, now I owe another 500 to the OC. 3 weeks ago I when the CA told me this was paid off I asked them to send me a statement showing the balance was $0, they never sent anything. I called the CA yesterday to ask what is going on. They transfered me 5 times and finally to a random voicemail, I didnt leave a message. So I called back later and they transfered me to another voicemail but this time it actually had someones name on the message. I left him a message then I placed a complaint on thier website explaining my entire story. I have yet to hear back from them. Any ideas where I should go from here or is there anything I can do?
This all just seems wrong. Once its paid, its paid correct?

Yes, but the problem is.......you got nothing in writing........so it only "looks" like a partial payment. I hope not, but it sounds like they are really trying to screw you.

You NEED to get a statement/receipt/letter that shows you paid and there is a zero balance. (paid in full,.......or at the very least settled). Otherwise you've got nothing but proof (with your canceled check) that you paid a portion.

I hope you can get through to someone at the CA.

So I finally got thru to someone that actually would talk to me. He said they would send me a reciept of payment, which is what I asked for.

I thought that once they sold the account to a CA it was sold?

I guess that it may be another $500 for me, but my other question is can I try a PFD for the OC if this does not resolve the problem or is that not a real long shot? I think I would rather pay the amount and get it off the report than have it satisfied.

If thats not going to be possible would it be a good idea to send a copy of the bill from the CA to the OC with the reciept of payment?

No, I don't see how it's possible that you paid the CA and the OC still wants it's money.

Is the OC reporting it? and if so, how is it reporting? (post it if you can) Is the CA reporting it?

That's what a CA's job is.......to collect for the OC. You accepted their settlement offer....unless they had no right to collect on that debt (which is possible but not probable), I don't see how you owe the OC one cent at this point.

And yes, I would send the OC a letter saying the account that they sold to the CA was settled through the CA along with a copy of the agreement and receipt of payment.
