Have a couple more questions to ask.After sitting dowm and talking to my wife about this,we are thinkink of trying to cut a deal with them.Our question is what do we ask for.Do we ask to get the amount down,amount that we can pay.Example;We figured our bills and if we cut back even more we could send $100 a month,in your opinon would that work. Aslo when we call them what do I ask,what docs,and if we agree on somthing do I or let them send paper work.Sorry for the questions and the bad typing I am visualy impaired. |

Well, when you talk to them.....I would start off by telling them your situation and that you really want this to stay out of court. Let them know how tight your budget is. If they act like it's possible, ask them what the minimum payment is that they would accept. If it's more than $100......then tell them what your max is. See if they will bend a bit (you could even start out at $75/mo to give yourself a buffer and some bargaining room). Hopefully they will be cool about it. If you guys can come to an agreement.......then just ask if they will send you something in writing stating what the monthly amount will be and that they will stop court proceedings as long as you make payments. Tell them you will be happy to send the first payment as soon as you get a written agreement (if it's possible, they could even fax you so it will go faster). Hope that answers your questions. p.s......if you get an a$$hole.......ask for their manager or hang up until you can find someone that is courteous. I have had to deal with companies over the phone and sometimes their CSRs are just plain nasty and rude. They somehow think that if you owe them money they have the right to speak abruptly. Those kind of CSRs will not work with you. So just keep trying until you can find a sympathetic ear......or someone that is at least polite. |

Try BOA first. If they direct you to the law office, then you may have to deal with them. Let us know how it goes. Keeping my fingers crossed for you that it works out. |

Called BOA they said it is in the lawyers hands,so not for sure what will happen now.The lawyer office was closed.

Thanks for more info and help.Found out more info on the papers that was served and pretty much how to respond to them. I do have another question,Me and my wife got to thinking about somthing.The amount they say we owe dose not seem to be right,there figure we think is high.The credit limit was not near the $5800+ amount.I was reading about a " debit validation letter " what is that for.Thanks |

Sorry for all the replys.Talked to the CA/lawyer and they agreed on a payment of $100 a month.We also have the right to pay off the ballance at any time .They are sending a letter to confirm the agreement. Thanks for all your help.
