Default Being sued by W&A

I am new here and have a question. I am being sued by Wolpoff & Abramson. The arbitration board has been appointed. I am on workers comp at this time and can't afford a lawyer and I am not eligible for free services. I have disputed the charges on this bill numerous times and wrote for them to send me copies of all billing statements and signiture cards. They sent the billing statements but no other info that I asked for. On the billing statement they say they had a balance transfer from another card for over $15,000.00 To my knowledge I have never had a Providian card and especially not one for this amount. It does not show up on any of my credit reports that I ever had this debt. There are also numerous charges that I know are not mine. How do I prove this card they say they paid was not mine?

It's not up to you to prove it. It's up to them to prove that you owe it. They must come up with the proper validation. If what you say is true, they probably won't be able to provide it.

Do not agree to pay it unless they can. Know your rights before you get into that court room.

You really should hire a lawyer, if at all possible. At least talk to one.

Thanks Chane for your reply. It is very confusing since on my credit reports it gives Bank of America as the adverse acct. and on the billing statements the name is AAA Financial Services. The numbers on these two accts. don't match only the first couple of numbers do. I wrote immediately for them to validate this acct. and they only send me copies of billing statements which state "This document is a copy of your statement for your records only. This copy is not a duplicate etc." They have not sent any signiture cards or anything else with my signiture on it, which I asked for. This acct also shows up on my husbands credit report as an authorized acct. but we have not been sent proof of this and we never shared accts. Also some of the big charges on this acct are from a natural gas co. which is not in this area and we own our own gas well so I do not need to buy gas. Any help is greatly appreciated.

Have you already tried disputing them with the CRAs?

No I just sent the letters out to dispute old personal info. I am trying to do it in order. Should I dispute them????????

Oh, I'm sorry. I didn't know exactly which steps you were on. You should definitely dispute them, but wait until you get the first letters back.

OK I don't want to mess up. Do you suggest I buy my credit reports from the 3 co's. so they have 30 days to respond instead of 45? Also if I dispute these acct. numbers won't they just put the new ones on my report? say if I dispute credit report acct. #12345 and it is not a valid number, won't the collection acct. co. provide them with the number on the statements? I'm sorry for so many questions, but being injured is a difficult ordeal to go through without all of this added stress. Again Thank you so much for having such a wonderful place for people who need help to come to........

Default Debt Validation Form

I sent a Debt Validation Form to Wolpoff & Abramson on May 24th. I used one I found on the forum. They received it May 27th 08 and have not responded, which makes it almost 60 days. What do I do now?? They have sent another letter from the Courthouse with an appointment of Arbitrators. This time one of the Arbitrators is an attorney which is the attorney I have used since 1986. Why would he agree to be an arbitrator?

You should definitely contact that attorney before your appointment and ask him what's up.
