Angry charge off account help

I have a charge off account on the three credit agencies that has past the statue of limitation in Texas (4yrs). It has been posted for 7 years by the same collection agency but has recently been transfer to another agency. What can I do to stop this from happening?

Dispute it with the credit bureaus. That should get it taken off...

But, you might also want to send the collection agencies a letter letting them know that it's a violation to report the same account for more than 7 years. You may also want to point out that it's past the SOL.

If it's past the states statute do you still owe the money ?

If it's past the SOL the collector can no longer attempt to collect on the debt. So, in legal terms, no you don't owe them money any more.

I got the same problem with some charge-offs, 4 years in texas SOL but still been reported, what letter could i use for this and when i write my letter should i also put that 2 verify that this account is really mine or they will take it off no matter what if is past the 4 years??

Do you have a link showing the SOL in TX to be 4yrs? If so I would like to include it in some letters to collection agencies as well.

Debt collection statute of limitations listed by state

J-Clark,

The above link is where the debt collection SOLs are listed. HOWEVER, don't misuse the SOLs. This SOL does not apply to how long your state can *report* the debt to the CRAs. Instead, it applies to how long your state has to go after you, the consumer, to *collect* the debt. So, even though they can't legally sue you or make any other moves to collect on this debt after four years, they can still report it and leave it on your credit report for seven years.
I see a lot of confusion about the SOLs.
