Default Can a person be sued by a debt collection

agency? My friend does not have a job and her husband is out of one now she owes credit cards, they are sending her to court, is that possible can she get in trouble if she can not pay.

Yes, and a judge can send you to jail where the few dollars you make per day in jail goes to settle your debt. Also, they can seize anything you own and sell it to cover your debts.

She could file for banckruptcy and they would not take away her house or car. She needs to talk to an attorney over the phone and see what his charges would be. Sometimes it is just $300.00 to wipe the slate clean. Good Luck.

She needs to look in the yellow pages (seriously) of the phone book. There are Attorneys that are nothing more than DEBT RELIEF Attorneys and can help her. AT least get the wolves off her back!!If she has no job, can she get a job. The fact is IF she is what is called Judgement Proof. If you draw Social Security Disability, you are judgment proof. Where she has no job, if she any assets, they can force the sale of all and any of those items to cover what she owes, including a vehicle.So the best thing to do is get an Attorney to see if they get something in writting to put a hault to the proceedings until she can at least get back to work and start paying something on those cards or for her to file Bankruptcy.
