Default How do I keep my home after filing bankruptcy?

Mort. comp. wants to foreclose? I want to know if there is anyway to keep the home even after filing chapter 7 bankruptcy. I want to know if there is any program that can assist me.

I think if you file bankruptcy, it means that you have no way of paying your debt , but if you have a home, then you have equity. Perhaps you should speak with a debt councillor and go that route instead of sticking that 7 year mark on your record. This will be a big hole to dig yourself out of. I hope you have exhausted all other avenues before filing Chapter 7.Good luck.

Contact a bankruptcy attorney who specializes in chapter 13. In my experience... credit counselors & debt solutions companies are frauds. They are in "cahoots" for lack of a better word with unsavory small business realtors that purchase foreclosed homes & resell them or rent them out to several people at once. Chapter 13 enables you to keep your home, cars, & belongings while still getting out from insurmountable debt. ( such as medical bills or back taxes)

If you can work out a repayment plan, you get to keep your house. If you can't repay past due payments AND your current payments, the court will lift the automatic stay and the foreclosure can proceed.

If you are current on ANY of your obligations be it car loan, credit card or mortgage you do not have to claim them in your bankruptcy. As long as you are current on your mortgage you cannot be foreclosed on. You should try to get the mortgage company to reaffirm your mortgage which basicaly means to sign a new agreement but if they refuse then don't worry about it. Just keep paying on time every month. As soon as possible you should try to remortgage if this company refuses to reaffirm.
