Default Husband active military, can I file for Bankruptcy?

My husband is active military. His credit is ok, and he has little to no debt in his name. Most of our debts is in my name only.Can I file for bankruptcy (chapter 13) in just my name? Will it affect him?

i would consult legal advise of a military attorney just to be on the safe side.

Wow let me know who you talk to. I had one take off 18 yearsago, I couldn't even get an i.d. card from the Military. "It is the service members duty to keep his dependants apprised of his whereabouts" I understand protecting a service member, as it is their duty. But who protects the spouse who's duty itis of the service member to protect.? Its really kinda ugly.

Yes you can , but be careful. Your husband could get into trouble with the UCMJ for not taking care of his debts.

You would get better results asking this question in the financial section of YA. There are some real experts there. It may take a few days longer to get an answer, but they helped me out pretty well. Military or not, your finances are the same as any other married couple.Also, some of the answers below this one are right on. Any kind of financial instability can effect security clearance. I am sure there is a solution. Don't ignore it thinking that it will go away.

consult jag first i do know that if your married even if one person has bad credit it could affect the other person just because you are married to them my father put the family in huge debt that way and compeletly screwed up my mothers credit because the bank sees it as you are both married and both providing so it is eachothers responsiblityjust seek jag scedule an appt with them and find out what you need to know i here soliders can get hurt pretty badly if filing for bankruptsy i would strongly to suggest to ask this in the finicial question too you may get better answers than in here

I would seek legal advice. If he has a clearance, your debts may be his and the filing could affect that.

no/yes if you fill as married you can hurt his credit but if you fill not married it well clear you up but it will be hard to get credit for about seven years
