Default Car was repo'd last night and it's a lease?

My husband came back from work around 3am and at 6am when I woke up, the car was gone. The car is a lease and the contract ended in August. We have been paying the car until then, except for the Sept. payment so we are late on that one. Our intentions were to keep the car and pay it the the cash out we were going to get from the refi of our homes but now we cannot refi because the situation is very sticky in that market and they are requiring us to have more income to get approved (funny, we already have a mortgage on this house, we are not buying a new one!). Anyway, we don't have the cash to buy out the car. Can they come to your house in the middle of the night and repo it without notifying you? They never called and the only mail we got was about taking the car to the dealer for an inspection, and this was two months ago. What is the situation? Are we screwed up? What are our options? Should we try to get the car buy (we would have to finance the residual)? Get another one?

i believe they can. When the lease ended in Aug, that 's when you either have to buy the car out /refinance into a regular auto loan or return the vehicle.
